The first time you access your accounts through Online Banking, you
agree to be bound by the terms and conditions of this Online Banking
Agreement (“Agreement”) and acknowledge its receipt and your
understanding of its terms.
In this agreement, the words “you” and “yours” refer to the Online
Banking customer. The terms “we”, “us”, and “our” refer to Coffee County
Bank.
Equipment and Technical Requirements
You are responsible for selecting all systems, hardware and your
Internet service provider and for any defect, malfunction or
interruption in service or security due to hardware failure, your choice
of Internet service provider, systems and computer services. We are not
responsible for any loss, injury or damages, whether direct, indirect,
special or consequential, caused by your Internet service provider, any
related software, the Bank’s Online Banking service or the use of any of
them or arising in any way out of the installation, use or maintenance
of your personal computer hardware, software or other equipment.
Virus, Spyware, Adware or Other Types of Malware Protection
Coffee County Bank is not responsible for any electronic malware that
you may encounter using Online Banking services. We encourage you to
routinely scan your computer and diskettes using reliable malware
protection products to detect and remove malware. If undetected and not
repaired, malware can corrupt and destroy your programs, files and
hardware or provide information to a third party regarding your Internet
activities.
Benefits of Online Banking
Through Online Banking, you can manage eligible accounts with a personal
computer via the Internet. Online Banking can be used to: Obtain
balances and transaction histories; transfer funds between eligible
accounts (each transfer through Online Banking from a savings or money
market account is counted as one of the six limited transactions
permitted each statement cycle, as described in the applicable account
agreement. In addition, if a hold is placed on any funds deposited in an
eligible account, you may not transfer the portion of funds being held
until that hold expires or is released); make transfers from eligible
accounts to make payments on your Coffee County Bank loan, and pay bills
through our Online BILL PAY service.
You must be an owner of and have the unrestricted right of withdrawal
from all accounts to or from which you request a transfer. Transfers are
not allowed to or from Certificates of Deposit, IRAs or from Christmas
Club accounts. Any account that requires two or more signatures to make
withdrawals, transfers or other transactions is not eligible for Online
Banking transactions.
Funds Transfer Permission
Coffee County Bank’s Online Banking will allow customers to transfer
funds between eligible types of deposit accounts.
Please note that Federal regulations prohibit you from making more than
six (6) pre-authorized or automatic transfers or bill payments from your
savings account or your money market accounts during any given monthly
statement period. Where check writing privileges are offered by the
Bank, no more than three of the six transfers may be made by check,
draft, debit card or similar order made by you and payable to a third
party. There are no limits to the number of transfers or payments from
your checking account. Federal regulations require the Bank to monitor
your compliance with these restrictions. We may be required to close
your account or take away your ability to make such transfers if these
restrictions are violated.
Coffee County Bank may, from time to time, introduce new Online Banking
services. By using those services when they become available, you agree
to be bound by the terms contained in this agreement, and its subsequent
amendments.
Statements
You will continue to receive your regular account statement either
monthly or quarterly, depending on the type of account.
Security and Protecting Your Account
We are strongly committed to protecting the security and confidentiality
of our customer’s account information. We use several techniques to help
secure our Online Banking service, including the following:
- You can only access Coffee County Bank with certain browsers
that have a high security standard.
- You must have a valid Access ID and Password to logon.
- If no action is taken for 15 minutes, you will be automatically
logged off the Online Banking service.
- Your password must be 8 to 16 characters in length and must
contain at least 2 numeric and 4 alpha characters.
- The system will prompt you to change your password every 6 (six)
months to continue accessing your account information online.
You agree to keep your password and logon information confidential
and not disclose or make the information available to anyone other than
authorized users of your accounts. Anyone to whom you disclose or has
access to your logon information will have full access to the services
you can perform on Online Banking, including full access to your
accounts. You have no ability to limit any such person’s authority. If
anyone uses your logon information with your permission, you will be
responsible for any transactions performed by that person.
Under no circumstances should a Bank employee request your password
through Online Banking, over the Internet or through other contact. Do
not respond to any such request, even if the person claims to represent
the Bank.
Customer Responsibility
If you believe someone has accessed your accounts without your
permission, or that someone has transferred or may transfer money from
your account without your permission, or if you have forgotten your
password, you should immediately call Coffee County Bank at (931)
728-1977 between 8:00 – 4:30 Monday through Friday.
Links to other Sites
Information that Coffee County Bank publishes on the World Wide Web may
contain links to other sites and third parties may establish links to
Coffee County Bank’s site. Coffee County Bank makes no representations
about any other web site that you may access to, from or through this
site. Unless expressly stated in writing, Coffee County Bank does not
endorse the products or services offered by any company or person linked
to this site nor is Coffee County Bank responsible for any software or
the content of any information published on the site of any third party.
You should take precautions when downloading files from sites to protect
your computer software and data from viruses and other destructive
programs.
Accessibility
You can usually access Online Banking services seven (7) days a week,
twenty-four (24) hours a day. However, at certain times, some or all of
Online Banking services may not be available due to system maintenance
or reasons beyond Coffee County Bank’s control. Coffee County Bank does
not warrant that Online Banking services will be available at all times.
An Online Banking service transaction initiated prior to 4:30 PM (CST)
on a business day is posted to your account the same day. All transfers
completed after 4:30 PM or on a non-banking day, will be posted the
following business day.
Business Day
Our business days for the purposes of this agreement (including
processing of claims of errors or performing other internal functions)
are Monday through Friday except for holidays.
Restrictions
You may not appropriate any information or material that violates any
copyright, trademark or other proprietary or intellectual property
rights of any person or entity while using our Online Banking services.
You may not gain, or attempt to gain, access to any Online Banking
service server, network or data not specifically permitted to you by
Coffee County Bank or its suppliers, and you must not include any
obscene, libelous, scandalous or defamatory content in any
communications with Coffee County Bank or its suppliers.
Fees and Charges
There is no fee for the use of our Online Banking service and our BILL
PAY service. Payments to Coffee County Bank accounts and transfers
between your Coffee County Bank accounts through our Online Banking are
free of charge. Payments through our BILL PAY are free of charge. Other
fees, such as overdraft fees, stop payment fees, monthly service
charges, dormant account charges, or loan payment late charges may still
apply.
Coffee County Bank’s Liability
Neither Coffee County Bank or its suppliers will be liable for any
transaction if: (1) you do not have enough money in your account to
complete the transaction; (2) a legal order prohibits withdrawals from
your account; (3) your account is closed or has been frozen, (4) the
transaction would cause your balance to go over the credit limit for any
credit arrangement set up to cover overdrafts; (5) you, or anyone you
allow, commits fraud or violates any law or regulation in connection
with Online Banking services; (6) any electronic terminal,
telecommunication device or part of the electronic funds transfer system
is not working properly; (7) you did not provide us with complete and
correct payment or transfer information; (8) you did not properly follow
the instructions for use of the Online Banking service; (9) you knew
that Online Banking services were not operating properly at the time you
initiated the transaction or payment; (10) there is postal delay; (11)
circumstances beyond our control (such as fire, flood or improper
transmission or handling by a third party) that prevent, hinder or delay
the transmission; (12) or if you believe someone has accessed your
accounts without your permission and you fail to notify us immediately.
In no instance will we be liable for damages in excess of your actual
loss due to our failure to complete a transaction and we will not be
liable for any incidental or consequential damages. If any of the
circumstances listed above occurs, we will assist you with reasonable
efforts in taking appropriate corrective action to reprocess the
transactions that may not have been completed or to correct incorrect
transactions that have been processed.
Confidentiality
We do not disclose non-public personal information about you to anyone,
except as permitted by law.
Our separate Privacy Policy can be obtained at our website or at either
of our Bank locations.
Modifications To This Agreement
Coffee County Bank has the right to modify or terminate these Terms and
Conditions at any time but will give you notice 30 days before the
amendment becomes effective unless such change or amendment is otherwise
required by law or applicable regulation. Such notice will be mailed to
you at the last address in our files. If, however, an immediate change
in Terms and Conditions is necessary for security reasons, we may alter
the Terms and Conditions without prior notice. If these Terms and
Conditions are modified, your continued use of the Online Banking
service will represent your acceptance of the modifications. We reserve
the right to terminate this Agreement and your use of the Online Banking
service in full or in part at any time without prior notice.
Assignment
You may not transfer or assign your rights or duties under this
Agreement.
Inactivity/Termination
You may terminate your Online Banking/BILL PAY by notifying Coffee
County Bank at (931) 728-1977 and provide your name and effective date
that you want the service terminated. If you have scheduled payments or
transfers, it is your responsibility to cancel those payments or
transfers.
We may convert your access to Online Banking/BILL PAY to inactive status
if you do not have any transactions scheduled through the service during
any consecutive 180-day period. If your service is considered inactive,
you must complete the enrollment form and bring it to the 301
Murfreesboro Highway location to have the service reactivated.
We reserve the right to terminate your enrollment in this service at any
time due to insufficient funds in one or more of your accounts, due to
your mishandling of your accounts or improper use of the Online Banking
service.
From time to time, we may deliver information to you that is required
by law or regulation to be provided to you in writing, or regarding
information about our services. By selecting the "Agree" button below,
you agree that we may provide you revisions and amendments to this
Agreement and such other information, including but not limited to
information under Regulation E and under other applicable banking or
financial services laws or regulations in connection with the services,
electronically as a part of the Agreement or otherwise as a apart of the
services. If you wish to withdraw consent to receive information, to
terminate the services, or to update your information, such as a change
of address or email address, you may call us at 1-931-728-1975 or send a
letter to Coffee County Bank, P O Box 1109, Manchester, TN 37349.
